Public Water and Sewer System Administration Ordinance 24

 

Section XI Service Deposit

 

WHEREAS, The Charter Township of Ironwood Board of Trustees finds that the current ordinance Number 24 should be amended to include the following:

 

 

1.     The Township shall have the right to require an initial deposit from any owner or tenant who applies for water and/or sewer system services, as security for the payment of the rates and charges for such services, and to apply said deposit against such rates and charges. Such deposit or portion there of not applied to aforesaid charges shall be refunded to the depositor, provided no delinquency then exits. Such deposit does not bear interest.

 

 

2.     In the event a tenant is responsible for the payment of water and sewage system services charges, and the Township is properly notified, in writing by affidavit, the notice to include a copy of the lease agreement of the effected premises, a lien shall not apply subsequent to the filing of the affidavit, PROVIDED HOWEVER, the affidavit contains a) provision that the tenant is responsible for payment of charges, and b) notation as the lease expiration date. In the event of filing of the affidavit, the Township shall render no further service to the premises until a cash deposit in a sum equivalent to six (6) times the average monthly water and sewer service charges to the premises is made as security for the payment of the charges. Landlord shall provide the Township Treasurer at least twenty (20) days advance written notice of any cancellation, change in, or termination of the lease. Following expiration of the lease or earlier because of a cancellation, change in or termination of the lease, whichever date is earliest, landlord shall be responsible for and obligated to pay all charges in connection with water and/or sewage system services to the premises, which charges shall constitute a lien upon the premises served.

 

THEREFORE, The Charter Township of Ironwood Board of Trustees adopts the Amendment to Ordinance No. 24 Public Water and Sewer System Administration.

 

A Motion was made by Fredrickson  supported by  Boyd to adopt an Amendment to Ordinance 24 to take effect immediately. The motion carried on a roll call vote as follows:

 

Yea: Fredrickson, Boyd, Salmi, Olson, Maki, Mattson.

Nay: None.

Absent: Brunello.

Abstain: None
